Resumen:
En las siguientes notas se presenta la iniciativa desarrollada por el Programa
de Cooperación UNICEF-Cuba en torno al Proyecto de Divulgación
de los Derechos de la Niñez y la Adolescencia, se ofrece una descripción
general del proceso de formación y desarrollo de este, con el interés
de introducir al lector en cómo, cuándo y por qué surge
en Cuba esta iniciativa para la cooperación, cómo se instrumenta,
cuáles son sus logros y limitaciones y los retos asumidos.
Project for advertising the rights of childhood and adolescence. Frameworks of the Cuban experience.
Summary:
In the following notes is presented the initiative developed by the UNICEF-Cuba
cooperation program about the Project for Advertising the Rights of Childhood
and Adolescence. This article offers a general description of the formation
process and development of Project for Advertising the Rights of Children and
Adolescents in Cuba, with the interest of introducing the reader in how, when
and why does this initiative emerge for the cooperation in Cuba, how is it implemented,
which are its achievements and limitations, as well as the assumed challenges.

Resumen:
El proyecto social cubano concibe a la infancia y la adolescencia como grupos
poblacionales altamente priorizados. La voluntad política del Gobierno
y el Estado garantiza, a través de un conjunto de normas jurídicas,
el respeto a los derechos de niños/as y adolescentes.
El presente artículo se propone compartir con el lector, los principales resultados obtenidos en investigaciones llevadas a cabo por el Centro de Estudios Sobre la Juventud, acerca del conocimiento que tienen niños/as y adolescentes respecto a sus derechos.
The voice of Cuban childhood and adolescence from social investigations.
Summary:
The Cuban social project conceives childhood and adolescence as high priority
population groups. The Government and State’s political will guarantees,
through a group of juridical norms, full respect regarding the rights of children
and adolescents.
The present article intends to share with the reader the main results obtained in investigations performed by the Centre for Youth Studies about how children and adolescents are aware of their rights.

Resumen:
En el artículo se destaca la necesidad de la protección social,
entendida esta como un derecho al que deben tener acceso todos los seres humanos.
Se hacer referencia además, a algunos documentos jurídicos internacionales
que consagran ese derecho, entre los que figuran la Declaración Universal
de los Derechos Humanos, aprobada por la Asamblea General de la Organización
de Naciones Unidas (ONU) en 1948 y la Convención sobre los Derechos del
Niño (CDN).
Asimismo, se hace una breve descripción del ordenamiento jurídico cubano y de los programas sociales vigentes en el país, que viabilizan en la práctica la aplicación de la citada Convención, como expresión de la voluntad política del Estado cubano, de garantizar a los niños, las niñas y los adolescentes la máxima protección posible desde antes de su nacimiento y en todas sus etapas de crecimiento.
Social protection of children and adolescents in Cuba.
Summary:
In the article, the necessity of the social protection is highlighted as a right
to which should have access all human beings. Reference is also made to some
international juridical documents consecrating that right, among those the Universal
Declaration of Human Rights, approved by the General Assembly of the United
Nations (UN) in 1948 and the International Convention on the Rights of the Child.
Likewise, a brief description of the Cuban juridical organization is made and the effective social programs in the country that facilitate in practice the application of the mentioned International Convention on the Rights of the Child, as expression of the political will of the Cuban State, for guaranteeing children, girls and adolescents the maximum possible protection even before their birth and in all stages of growth.

Resumen:
El Proyecto “Los chicos del barrio”, focaliza los niños,
adolescentes y jóvenes de familias en situación de desventaja
y debe aportarles un currículo compensador, que les estimule desde el
aula y otros espacios socializadores en su desarrollo personal. A la vez que
aspira a incidir en las familias y en la comunidad, para mejorar las condiciones
educativas en que se desenvuelven los menores.
He generado su enfoque de transformación prioritariamente desde talleres participativos. Los mismos permiten, a la vez, la comprensión más profunda de los efectos de la desventaja y de los procesos compensadores. En este texto se analizan los fundamentos de esta transformación desde un enfoque de derechos y sus relaciones con la investigación participativa.

“Boys of the neighborhood”.
Participation and integration of children, adolescents and youths in social
disadvantage.
Summary:
The Project “Boys of the neighborhood” works with children, adolescents
and youths coming from families in disadvantage situation, and it should give
them a compensatory curriculum that stimulates them from the classroom and other
social spaces in their personal development. At the same time, there is an aspiration
to impact in the families and the community, to improve the educational conditions
in which minors are involved.
It has generated a transforming approach especially from participating workshops. These workshops allow the deepest understanding of the effects of disadvantage and of the compensatory processes. The foundations of this transformation are analyzed in this text with an approach of rights and their relationships with the participating investigation.

Resumen:
La cultura atañe a todos los seres humanos, aunque con diferentes grados
de conciencia y desde diversas perspectivas. Si bien no es propósito
de estas líneas teorizar al respecto, sería conveniente partir
al menos de la consideración de que, entendida en sentido amplio, la
cultura, tanto en sus realizaciones individuales como colectivas, resulta de
procesos de acumulación y sedimentación, históricamente
condicionados, de diversos elementos materiales y espirituales, que van desde
las más elaboradas expresiones artísticas hasta lo más
común de la vida cotidiana.
El tema de los derechos de la niñez y la adolescencia no se dirime sólo en el terreno legal. Requiere de la participación de un amplio espectro de factores sociales, entre ellos la cultura. En este artículo comentaremos la cultura, en tanto se convierte en escenario para el ejercicio de los derechos.
Culture as scene for the practice of rights in childhood and adolescence.
Summary:
Culture is all human being’s concern, though with different levels of
consciousness and from different points of view. If the main purpose of these
work is not to theorize about it, it would be convenient to start, at least,
from considering that culture, broadly understood, as much as in its individual
and collective realizations, is a result of accumulation and sedimentation processes,
historically conditioned, of diverse material and spiritual elements, parting
from the most elaborated artistic expressions to the commonest events of daily
life.
The subject of children and adolescents’ rights is not only settled in the global field. It requires the participation of a wide spectrum of social factors, among them culture. In this article we will comment culture, whilst it becomes a scene for the practice of these rights.

Es propósito de este artículo dar a conocer algunos resultados
de investigaciones realizadas por el Grupo de Desarrollo Sociocultural para
la Infancia y la Adolescencia, que se desarrollan con la intención de
contribuir al perfeccionamiento del trabajo cultural con niños, niñas
y adolescentes y específicamente presentar algunos resultados del Estudio
de intereses artísticos culturales, que ha permitido conocer en alguna
medida el modo en que los y las adolescentes disfrutan de la cultura.
Adolescence, rights to the culture and cultural
interests
Summary
It is purpose of this article to give to know some results of investigations
carried out by the Group of Sociocultural Development for the Childhood and
Adolescence which are developed with the intention of contributing to the improvement
of the cultural work with children, girls and adolescent and to present specifically
some results of the study of cultural artistic interests that allowed to know
in some measure the way in what adolescents enjoy the culture.

Resumen
La actitud patriarcal de algunas sociedades asumida hacia las mujeres, repercute
desfavorablemente en el proceso de crecimiento y desarrollo de las niñas,
que luego adolescentes, llegan a creer que tanta discriminación es una
condición natural.
La explotación del hombre sobre la mujer, las limitaciones en cuanto a la salud, la educación, el empleo, el poder, el maltrato y abuso sexual, son solo algunas de las formas de discriminación contra la mujer que existen en el mundo. En estas páginas reflexionaremos sobre el derecho que les asisten a las niñas, las adolescentes y a las mujeres.
Women and their rights: necessary reflections
Summary:
The patriarchal attitude assumed by some societies toward women unfavorably
affect in the process of growth and development of the little girls and then
adolescents, end up believing that so much discrimination is a natural condition.
The man's exploitation against the woman, the limitations according to the health, the education, the employment, the access to the power, the abuse and sexual abuse, they are not only some in the discrimination ways against the woman that exist in the world. In these pages, we will meditate about the rights that assist the girls, the adolescents and the women.

Resumen:
La aprobación de la Convención Internacional de los Derechos del
Niño (CDN) por la Asamblea General de Naciones Unidas en noviembre de
1989 y el posterior, rápido y extendido proceso de ratificaciones, provocó
en América Latina- a través de procesos nacionales de reforma
legal destinados a adecuar la legislación interna a la CDN- una serie
de transformaciones cuyo impacto real ha sido, y es todavía hoy, externamente
difícil de evaluar. Se distinguen aquí tres etapas diferenciadas
de un proceso:
Una primera y muy breve etapa- de transición de paradigmas- que va de la aprobación de la CDN en noviembre de 1989, hasta fines de 1991. Una segunda etapa, de expansión jurídico-cultural de autonomía de la infancia entre 1992 y 1997, en la que se producen la mayor cantidad de reformas legislativas y durante la cual se interpretan, adoptan y desarrollan en clave de derechos humanos los principios más importantes sobre las que se estructura la CDN y por último una tercera etapa- de involución represiva discrecional inaugurada, probablemente, con los burdos decretos fujimoristas de “Terrorismo Agravado” y “ Pandillaje Pernicioso”de mayo de 1998. En este trabajo, también se puede encontrar un análisis sobre la doble crisis de los derechos de la infancia en América Latina denominadas: implementación e interpretación, respectivamente.
Between the authoritarianism and the banality: Childhood and Rights in Latin America.”
Summary:
The approval of the International Convention on the Rights of the Child (CDN)
for the General Assembly of United Nations in November, 1989 and the later,
quick and extended process of ratifications, it caused in Latin America - through
national processes of legal reformation dedicated to adapt the internal legislation
to the CDN - a series of transformations whose real impact has been, and it
is still today, externally difficult to evaluate. They are distinguished three
differentiated stages of a process here:
A first and very brief stage – in accordance with the transition of paradigms - that goes from the approval of the CDN in November of 1989, to the ends of 1991. A second stage, of juridical-cultural expansion of autonomy of the childhood between 1992 and 1997, in which it takes place the biggest quantity in legislative reforms and during which are interpreted, they adopt and they develop in key of human rights the most important principles on those that the CDN is structured and lastly a third stage - of inaugurated discretionary repressive involution, probably, with the coarse ordinances of Fujimory president about “Increased Terrorism” and “Pernicious gang” in May, 1998. In this paper, it can also be an analysis on the double crisis of the rights of the childhood in denominated Latin America: implementation and interpretation, respectively.

Resumen:
A través de este artículo presentaremos un aporte crítico
al concepto de la “Reinserción Social”, que se basa fundamentalmente
en un modelo médico. También se hará todo un análisis
acerca del capitalismo y la generación de un amplio espectro de conflictos
en el mundo, protagonizados por todos los sectores que están en desventaja
económica, social, política y cultural, e incluso por aquellos
que quieren aún más ventajas de las que tienen; dividiendo al
mundo en ricos y pobres y creando condiciones de explotación como nunca
antes en la historia, generando así la delincuencia en dos direcciones:
delincuencia de RICOS y delincuencia de POBRES. Nos detendremos un poco en el
rol de las pandillas juveniles, su surgimiento, lo que persiguen los jóvenes
con estas bandas y a qué intereses responden. Se realizará, también,
todo un análisis para demostrar que el concepto de “Reinserción
Social” es contrario al enfoque punitivo penitenciario.
Critical perspective facing the concept of “Social Reinsertion”
Summary:
Through this article, we will present a critical contribution to the concept
of “Social Reinsertion” which is based fundamentally in a medical
model. A whole analysis will made about capitalism and the generation of a wide
spectrum of conflicts in the world, played by all sectors that are in economic,
social, political and cultural disadvantage, and even for those who want even
more advantages that they actually have; dividing the world in rich and poor
and creating conditions of exploitation like never before in history, generating,
thus, a two-way delinquency: the ONE of the RICH and the one of the POOR. We
will stop in the role of the juvenile gangs, their origin, what young people
pursue with gangs and to what interest they respond. It will also carried out
a whole analysis to demonstrate that the concept of “Social Reinsertion”
is contrary to the penitentiary, punitive point of view.
